Davis & Santos, PLLC Partner Jay Hulings and Associate Landon Hankins, representing Saks Fifth Avenue, scored an appellate victory  in a September 1, 2022 Opinion from the 14th Court of Appeals. In the district court, Appellee Ya Xi Li sued her former employer, appellant Saks Fifth Avenue, and other employees for malicious prosecution and defamation. Appellants filed a motion to dismiss these claims under the Texas Citizen’s Participation Act (TCPA), and the trial court denied the motion. In its Opinion, the 14th Court of Appeals reversed the trial court’s ruling, dismissing Plaintiff’s claims of defamation and malicious prosecution.
