Davis & Santos, PLLC scores a major victory for its clients in federal court in Houston, Texas.

On December 10, 2025, Judge Kenneth Hoyt of the U.S. District Court for the Southern District of Texas granted a motion to dismiss filed by Davis & Santos PLLC on behalf of its clients—Laura Tran Le, DC and Thao T. Huynh, DC, two Houston-area medical professionals.  The suit involved claims by Allstate Insurance Company (“Allstate”) that the defendants violated the Racketeering Influenced and Corrupt Organization Act (“RICO”) by treating patients who had filed claims with Allstate. The motion filed by Davis & Santos PLLC argued that Allstate’s settlements with personal injury attorneys broke the chain of causation needed to assert a violation of RICO, among other arguments. In a decision with wide-ranging potential implications for the practice of medicine in Texas, the Court agreed and dismissed the complaint against Dr. Le and Dr. Huynh with prejudice.  The case is Allstate Ins. Co., et al., v. Innovo Management, LLC, et al., Civil Action No. 4:25-CV-00368 (S.D. Tex.).

This is the second time Davis & Santos, PLLC secured the dismissal of a RICO complaint brought by an insurance conglomerate. In 2024, a federal court in Houston, Texas granted the motion for summary judgment filed by Davis & Santos, PLLC on behalf of a group of doctors and medical practices who had been sued by Farmers Texas County Mutual Insurance Company (and others) for violation of RICO. That case is Farmers Texas County Mutual Ins. Co., et al., v. Robert A. O’Neal, D.C., et al., Civil Action No. 4:20-CV-04152 (S.D. Tex.).
