Davis & Santos Founding Partner Sarah Santos presented to the Southwest Association of Bank Counsel’s 2022 Annual Legal Conference held in Fort Worth, Texas, on the enforcement of guaranty agreement and the significance of the language that is used in guaranty agreements.  Her presentation focused in part on Sarah’s recent appellate win involving a bank guaranty.  The opinion from the Fourteenth Court of Appeals, which reversed a trial court judgment and rendered judgment for Sarah’s client on a breach of guaranty claim, upheld the enforcement of a guaranty agreement against a guarantor, even when a bank settles with a borrower and other co-guarantors.  Because guaranty agreements are an important aspect of the banking system, and their enforcement is critical, Sarah emphasized the importance of carefully drafting guaranty agreements.   To review the Appellate Court decision, click here.  For further information about the Southwest Association of Bank Counsel, click here.
